On May 22, 2023, Resolution <\/span>No.<\/span> 18\/2023 of the Secretariat of Agriculture, <\/span>Livestock and<\/span> Fisheries and the Secretariat of Health Quality was published in the Official Gazette of the Nation, amending the Argentine Food Code <\/span>(hereinafter “<\/span>The Code<\/span>“)<\/span>by adding two articles to Chapter <\/span>XXI<\/span> “<\/span> Procedures”<\/span> on <\/span>the technical and sanitary requirements for the Sanitary Authorization of Food Establishments and the Sanitary Authorization of Food Products.<\/span><\/p>\n

This <\/span>is within the scope of the FEDERAL FOOD CONTROL PROGRAM (PFCA), which constitutes an internal work guide <\/span>within <\/span>the framework<\/span> of the National Administration of Drugs,<\/span>,<\/span> Food and Medical Technology (“ANMAT”<\/span> for its acronym in Spanish), in which the priorities, objectives and goals, as well as the specific actions to be carried out in the short and medium term are communicated.<\/span><\/p>\n

Through this program,<\/span> food control health authorities established the need to develop guidelines with harmonized and agreed-upon procedures to strengthen the National Food Control System (SNCA).<\/span><\/p>\n

In turn,<\/span> the National Food Commission (\u201cCONAL\u201d in Spanish) intervened,<\/span>which determined <\/span>that<\/span>the<\/span> “Guidelines for the Sanitary Authorization of Establishments” <\/span>defined <\/span>by ANMAT Provision <\/span>No.<\/span> 14023\/2016, <\/span>14023\/2016, <\/span>and recommended by CONAL according to Act <\/span>No.<\/span> 109, should be revised to harmonize the technical and sanitary requirements for the Sanitary Authorization of Establishments according to CONAL Act <\/span>No. 12<\/span>120.<\/span><\/p>\n

First, <\/span>Article <\/span>No. <\/span>1416<\/span> bis was <\/span>incorporated into the Code, which defined the provisions applicable by the health authorities for the sanitary authorization of a food establishment <\/span>requesting registration, re-registration, modification and\/or update in the Register of Establishments. <\/span>Annex I of the Resolution <\/span>No.<\/span> 18\/2023 includes: <\/span><\/p>\n

    \n
  1. Definitions of applicable terms<\/span>;<\/span><\/li>\n
  2. The information<\/span> and documentation requirements<\/span> to be completed by the applicants<\/span> (<\/span>Owner’s data<\/span>,<\/span> establishment data and technical<\/span> director’s data);<\/span><\/li>\n
  3. The administrative procedure<\/span> to be carried<\/span> out in<\/span> order to obtain the<\/span> authorization of food establishments<\/span> and,<\/span><\/li>\n
  4. The minimum <\/span>information <\/span>that must be included in the Certificate of Establishment Registration issued by the authority,<\/span>i.e.: The <\/span>registration<\/span> number,<\/span>, <\/span>the<\/span>identification code<\/span>, <\/span>, the establishment owner’s data, the<\/span>date of issuance of the certificate<\/span>and its<\/span>expiration date,<\/span>and the<\/span>signature of the person in charge of the Competent Health Authority.<\/span><\/li>\n<\/ol>\n

    The minimum information that must be included in the Certificate of Establishment Registration issued by the authority, i.e.: Article<\/span> No<\/span>. 1416 tris, on the sanitary<\/span> authorization of a food product, was also incorporated into the Code.<\/span>. Annex II of the Resolution incorporates:<\/span><\/p>\n

      \n
    1. The requirements for obtaining sanitary authorization for a food product; <\/span><\/li>\n
    2. The information that must be included <\/span>in the Food Product Registration Certificate<\/span> , among which are: the <\/span>issuing Competent Health Authority<\/span>, <\/span>, registration<\/span> number,<\/span>product<\/span>data,<\/span>product holder data,<\/span>the date of issuance of the certificate <\/span>and<\/span>its expiration date, <\/span>and the<\/span>signature of the person in charge of the Competent Health Authority;<\/span><\/li>\n
    3. Food product categories. <\/span><\/li>\n<\/ol>\n

      Finally, a term of one hundred and eighty (180) calendar days was granted for its adaptation and implementation. <\/span><\/p>\n
