of the Argentine Food Code"},"content":{"rendered":"<p class=\"s12\"><span class=\"s8\">On May 22, 2023, Resolution <\/span><span class=\"s8\">No.<\/span><span class=\"s8\"> 18\/2023 of the Secretariat of Agriculture, <\/span><span class=\"s8\">Livestock and<\/span><span class=\"s8\"> Fisheries and the Secretariat of Health Quality was published in the Official Gazette of the Nation, amending the Argentine Food Code <\/span><span class=\"s8\">(hereinafter &#8220;<\/span><span class=\"s8\">The Code<\/span><span class=\"s8\">&#8220;)<\/span><span class=\"s8\">by adding two articles to Chapter <\/span><span class=\"s8\">XXI<\/span><span class=\"s8\"> &#8220;<\/span><span class=\"s8\"> Procedures&#8221;<\/span><span class=\"s8\"> on <\/span><span class=\"s8\">the technical and sanitary requirements for the Sanitary Authorization of Food Establishments and the Sanitary Authorization of Food Products.<\/span><\/p>\n<p class=\"s12\"><span class=\"s8\">This <\/span><span class=\"s8\">is within the scope of the FEDERAL FOOD CONTROL PROGRAM (PFCA), which constitutes an internal work guide <\/span><span class=\"s8\">within <\/span><span class=\"s8\">the framework<\/span><span class=\"s8\"> of the National Administration of Drugs,<\/span><span class=\"s8\">,<\/span><span class=\"s8\"> Food and Medical Technology (&#8220;ANMAT&#8221;<\/span><span class=\"s8\"> for its acronym in Spanish), in which the priorities, objectives and goals, as well as the specific actions to be carried out in the short and medium term are communicated.<\/span><\/p>\n<p class=\"s12\"><span class=\"s8\">Through this program,<\/span> <span class=\"s8\">food control health authorities established the need to develop guidelines with harmonized and agreed-upon procedures to strengthen the National Food Control System (SNCA).<\/span><\/p>\n<p class=\"s12\"><span class=\"s8\">In turn,<\/span><span class=\"s8\"> the National Food Commission (\u201cCONAL\u201d in Spanish) intervened,<\/span><span class=\"s8\">which determined <\/span><span class=\"s8\">that<\/span><span class=\"s8\">the<\/span><span class=\"s8\"> &#8220;Guidelines for the Sanitary Authorization of Establishments&#8221; <\/span><span class=\"s8\">defined <\/span><span class=\"s8\">by ANMAT Provision <\/span><span class=\"s8\">No.<\/span><span class=\"s8\"> 14023\/2016, <\/span><span class=\"s8\">14023\/2016, <\/span><span class=\"s8\">and recommended by CONAL according to Act <\/span><span class=\"s8\">No.<\/span><span class=\"s8\"> 109, should be revised to harmonize the technical and sanitary requirements for the Sanitary Authorization of Establishments according to CONAL Act <\/span><span class=\"s8\">No. 12<\/span><span class=\"s8\">120.<\/span><\/p>\n<p class=\"s12\"><span class=\"s8\">First, <\/span><span class=\"s8\">Article <\/span><span class=\"s8\">No. <\/span><span class=\"s8\">1416<\/span><span class=\"s8\"> bis was <\/span><span class=\"s8\">incorporated into the Code, which defined the provisions applicable by the health authorities for the sanitary authorization of a food establishment <\/span><span class=\"s8\">requesting registration, re-registration, modification and\/or update in the Register of Establishments. <\/span><span class=\"s8\">Annex I of the Resolution <\/span><span class=\"s8\">No.<\/span><span class=\"s8\"> 18\/2023 includes: <\/span><\/p>\n<ol>\n<li class=\"s14\"><span class=\"s8\">Definitions of applicable terms<\/span><span class=\"s8\">;<\/span><\/li>\n<li class=\"s14\"><span class=\"s8\">The information<\/span> <span class=\"s8\">and documentation requirements<\/span> <span class=\"s8\">to be completed by the applicants<\/span> <span class=\"s8\">(<\/span><span class=\"s8\">Owner&#8217;s data<\/span><span class=\"s8\">,<\/span> <span class=\"s8\">establishment data and technical<\/span> <span class=\"s8\">director&#8217;s data);<\/span><\/li>\n<li class=\"s14\"><span class=\"s8\">The administrative procedure<\/span> <span class=\"s8\">to be carried<\/span> <span class=\"s8\">out in<\/span> <span class=\"s8\">order to obtain the<\/span> <span class=\"s8\">authorization of food establishments<\/span> <span class=\"s8\">and,<\/span><\/li>\n<li class=\"s14\"><span class=\"s8\">The minimum <\/span><span class=\"s8\">information <\/span><span class=\"s8\">that must be included in the Certificate of Establishment Registration issued by the authority,<\/span><span class=\"s8\">i.e.: The <\/span><span class=\"s8\">registration<\/span><span class=\"s8\"> number,<\/span><span class=\"s8\">, <\/span><span class=\"s8\">the<\/span><span class=\"s8\">identification code<\/span><span class=\"s8\">, <\/span><span class=\"s8\">, the establishment owner&#8217;s data, the<\/span><span class=\"s8\">date of issuance of the certificate<\/span><span class=\"s8\">and its<\/span><span class=\"s8\">expiration date,<\/span><span class=\"s8\">and the<\/span><span class=\"s8\">signature of the person in charge of the Competent Health Authority.<\/span><\/li>\n<\/ol>\n<p class=\"s12\"><span class=\"s8\">The minimum information that must be included in the Certificate of Establishment Registration issued by the authority, i.e.: Article<\/span> <span class=\"s8\">No<\/span>. <span class=\"s8\">1416 tris, on the sanitary<\/span> <span class=\"s8\">authorization of a food product, was also incorporated into the Code.<\/span><span class=\"s8\">. Annex II of the Resolution incorporates:<\/span><\/p>\n<ol>\n<li class=\"s16\"><span class=\"s8\">The requirements for obtaining sanitary authorization for a food product; <\/span><\/li>\n<li class=\"s16\"><span class=\"s8\">The information that must be included <\/span><span class=\"s8\">in the Food Product Registration Certificate<\/span><span class=\"s8\"> , among which are: the <\/span><span class=\"s8\">issuing Competent Health Authority<\/span><span class=\"s8\">, <\/span><span class=\"s8\">, registration<\/span><span class=\"s8\"> number,<\/span><span class=\"s8\">product<\/span><span class=\"s8\">data,<\/span><span class=\"s8\">product holder data,<\/span><span class=\"s8\">the date of issuance of the certificate <\/span><span class=\"s8\">and<\/span><span class=\"s8\">its expiration date, <\/span><span class=\"s8\">and the<\/span><span class=\"s8\">signature of the person in charge of the Competent Health Authority;<\/span><\/li>\n<li class=\"s16\"><span class=\"s8\">Food product categories. <\/span><\/li>\n<\/ol>\n<p class=\"s12\"><span class=\"s8\">Finally, a term of one hundred and eighty (180) calendar days was granted for its adaptation and implementation. <\/span><\/p>\n<h6 class=\"s12\"><span class=\"s8\">This report cannot be considered as legal or any other kind of advice by Allende &amp;
