{"id":11509,"date":"2024-01-05T10:32:40","date_gmt":"2024-01-05T13:32:40","guid":{"rendered":"https:\/\/allende.com\/administrative\/the-bill-titled-law-of-basis-and-starting-points-for-the-freedom-of-argentines-will-be-discussed-within-the-extraordinary-legislative-sessions-01-03-2024\/"},"modified":"2025-05-21T15:14:24","modified_gmt":"2025-05-21T18:14:24","slug":"the-bill-titled-law-of-basis-and-starting-points-for-the-freedom-of-argentines-will-be-discussed-within-the-extraordinary-legislative-sessions","status":"publish","type":"post","link":"https:\/\/allende.com\/en\/argentine-reform\/economic-deregulation\/the-bill-titled-law-of-basis-and-starting-points-for-the-freedom-of-argentines-will-be-discussed-within-the-extraordinary-legislative-sessions-01-05-2024\/","title":{"rendered":"The omnibus bill would be discussed during the extraordinary session period"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">On December 27, 2023, the National Executive Power (\u201cPEN\u201d) presented <a href=\"https:\/\/allende.com\/wp-content\/uploads\/2024\/01\/PE194_23MD-1.pdf\">the bill <\/a> titled<\/span> &#8220;<span style=\"font-weight: 400;\">Law on Foundations and Starting Points for the Freedom of Argentinians<\/span>&#8221; (the \u201cProject\u201d) to the Chamber of Deputies of Congress.<\/p>\n<p><span style=\"font-weight: 400;\">The <a href=\"https:\/\/allende.com\/wp-content\/uploads\/2024\/01\/PE194_23MD-1.pdf\"> Bill<\/a><\/span> <span style=\"font-weight: 400;\">is a comprehensive draft law featuring 664 sections contained in 183 pages, together with six Annexes (that in turn contain other bills) for a total of 351 pages. The Bill is set to <\/span><span style=\"font-weight: 400;\">be discussed within the extraordinary legislative sessions convened for the period from 26 December to 31 January.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Bill sets forth the declaration of public emergency in economic, financial, fiscal, <\/span><span style=\"font-weight: 400;\">social security, national defense, tariff, energy, health, social and public administration matters until December 31, 2025. Said term can be extended by the PEN for a maximum of two years. Furthemore, the Bill establishes that the faculties contained in it can be delegated to the PEN.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Project addresses multiple issues, including several related to communication, culture, and technology; electoral matters; <a href=\"https:\/\/allende.com\/defensa-de-la-competencia\/proyecto-de-ley-para-la-sancion-de-una-nueva-ley-de-defensa-de-la-competencia-12-28-2023\/\">competition law<\/a>; taxation; privatizations; foreign trade; health; labor; reorganization of the State and administrative procedures; energy; internal security; agricultural transactions; movable and immovable property; among others. The provisions of Decree No. 70\/2023 are also ratified.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The most relevant reforms include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A total of 41 state-owned companies are to be privatized, including YPF (National oil company), Aerol\u00edneas Argentinas (National airline) , AYSA (National water supplier), Correo Argentino (National mail) and Banco de la Naci\u00f3n Argentina (National bank).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The PEN is authorized to dispose of the shares or capital of the National State and\/or its entities in any private company that does not provide the majority of the necessary social capital to exercise control over such entities.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">All regulation will require a prior regulatory impact analysis that includes an assessment where costs justify benefits, necessity, and reasonableness of the regulation (including chosen means), taking into account the economic, social, environmental, public health, and security effects to occur.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A broad reorganization of the public administration.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A national single entry is created for the central public administration, <a href=\"https:\/\/allende.com\/privacidad-y-ciberseguridad\/digitalizacion-y-firma-electronica-segun-el-dnu-70-2023-y-el-nuevo-proyecto-de-ley-de-bases-y-puntos-de-partida-para-la-libertad-de-los-argentinos-12-28-2023\/\">mandatory electronic procedures<\/a> are established, and a process of paperless transition for the National State is to be completed within a period of two (2) years.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reform of the Anti Corruption Act.<\/span><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/allende.com\/life-sciences\/modificaciones-al-regimen-de-salud-mental-segun-el-proyecto-de-ley-de-bases-y-puntos-de-partida-para-la-libertad-de-los-argentinos-01-03-2024\/\">The mental health regime is modified.<\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reform of the law on public ethics to establish restrictions on advertising by public officials, especially in digital media (e.g. using official social networks for personal promotion or electoral candidacy) and prohibiting the use of state resources for electoral purposes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The State is allowed to employ and be a party to alternative dispute resolution methods both locally and in foreign jurisdictions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reform of the administrative procedures act.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A wide deregulation of the economy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Repeal of the single book price law, reform of the National Institute of Music (&#8220;Inamu&#8221;), and elimination of the National Theatre Institute and the National Fund for the Arts.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Introduces <a href=\"https:\/\/allende.com\/defensa-de-la-competencia\/proyecto-de-ley-para-la-sancion-de-una-nueva-ley-de-defensa-de-la-competencia-12-28-2023\/\"> new Antitrust law and creates the Market and Competition Agency as the Supervisory Authority.<\/a><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Legalizes reselling of sports events tickets.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The customs regulations for carry-on luggage are reformed, revoking the current customs allowance.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The regulation subjecting the installation and use of systems for the reception of broadcasting signals from satellites to the media law is repealed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><a href=\"https:\/\/allende.com\/propiedad-intelectual\/se-desregula-la-creacion-de-sociedades-de-gestion-colectiva-de-derechos-de-autor-y-derechos-conexos-01-11-2024\/\">The creation of Copyright Collective Management Associations is deregulated<\/a>, allowing more than one per field and allowing creators to choose whether or not to be represented by them.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amendment of the Insurance Law to allow the opening of new insurance branches.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amendment of the Companies Law to allow the creation of single member public limited single member and limited liability companies.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Introducing a system for regularization of tax, customs, and social security obligations is established with the aim of achieving the voluntary payment of such obligations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A regularization regime for assets located in Argentina or abroad is created.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The National Institute Against Discrimination, Xenophobia and Racism is dissolved.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Introduction of measures relating to the Bioeconomy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reform of the film law, the structure of the National Institute of Cinema and Audiovisual Arts and its functioning. <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Bill introduces the prohibition of the use of the word &#8220;free or similar&#8221; in the advertising of State services or benefits and provides that it must be made clear that it is &#8220;free access financed by taxpayers&#8217; contributions&#8221;.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reforms to the hydrocarbons regime.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The National Gas Regulation Agency and the National Electricity Regulation Agency are merged into a single National Electricity and Gas Regulation Agency.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/allende.com\/agronegocios\/el-proyecto-de-ley-omnibus-propone-la-adhesion-a-la-convencion-internacional-sobre-la-proteccion-de-nuevas-variedades-vegetales-upov-91-01-10-2024\/\"><span style=\"font-weight: 400;\">It is <\/span> proposed to accede to the International Convention for the Protection of New Varieties of<\/a> Plants (UPOV 91).<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The <a href=\"https:\/\/allende.com\/wp-content\/uploads\/2024\/01\/PE194_23MD-1.pdf\">Bill<\/a><\/span> <span style=\"font-weight: 400;\">contains six annexes with five different bills that include:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\">Annex I: List of State-Owned Companies subject to privatization.<\/span><\/li>\n<li>Annex II: <a href=\"https:\/\/allende.com\/administrativo\/incentivos-a-las-grandes-inversiones-segun-el-proyecto-de-ley-de-bases-y-puntos-de-partida-para-la-libertad-de-los-argentinos-01-03-2024\/\">Incentive Scheme for Large Investments (ISLI).<\/a><\/li>\n<li>Annex III: <a href=\"https:\/\/allende.com\/defensa-de-la-competencia\/proyecto-de-ley-para-la-sancion-de-una-nueva-ley-de-defensa-de-la-competencia-12-28-2023\/\">Antitrust Law.<\/a><\/li>\n<li>Annex IV: Succession Law.<\/li>\n<li>Annex V: <a href=\"https:\/\/allende.com\/administrativo\/incentivos-a-las-grandes-inversiones-segun-el-proyecto-de-ley-de-bases-y-puntos-de-partida-para-la-libertad-de-los-argentinos-01-03-2024\/\">Industries to
