{"id":21713,"date":"2026-03-18T12:22:47","date_gmt":"2026-03-18T15:22:47","guid":{"rendered":"https:\/\/allende.com\/?p=21713"},"modified":"2026-03-20T11:24:04","modified_gmt":"2026-03-20T14:24:04","slug":"new-list-of-abusive-clauses-in-consumer-agreements","status":"publish","type":"post","link":"https:\/\/allende.com\/en\/privacy-and-cybersecurity\/new-list-of-abusive-clauses-in-consumer-agreements-03-18-2026\/","title":{"rendered":"New list of abusive clauses in consumer agreements"},"content":{"rendered":"<p>By means of Rule 377\/2026, the Undersecretariat for Consumer Protection and Fair Trade, under the Secretariat of Industry and Commerce of the Ministry of Economy, approved a new list of provisions which constitute abusive clauses in consumer agreements, in accordance with Consumer Protection Law No. 24,240.<\/p>\n<p>The new Rule keeps the abusive clauses already included in the previous regulation, such as those granting suppliers unilateral powers to interpret the agreement, modify its terms or terminate it without cause; those limiting or restricting the exercise of consumers\u2019 rights; and those excluding or limiting the supplier\u2019s liability for damages arising from the product purchased or the service provided.<\/p>\n<p>Additionally, the new Rule incorporates provisions that were not included in the previous list.
