New executive order modifying the national immigration law and the law for obtaining Argentine citizenship

On May 29, 2025, executive order 366/2025 was published in the Official Gazette, which seeks to reinforce immigration controls, establish greater limits regarding residence permits, and facilitate the obtaining of Argentine citizenship through the accreditation of an investment in the country. Knowing these legal aspects is of vital importance to be able to develop an effective immigration strategy that allows companies to eliminate any type of risk and establish the guidelines to follow when requiring personnel from abroad.

The executive order establishes, among other modifications, that those foreigners entering the country must prove additionally that they have contracted medical insurance and sign an affidavit of the reason for their trip. The immigration authorities may deny entry into the country if it is proven that the declared reason for entry does not correspond with the real reason of the trip.

It is added as a requirement for the processing of permanent residence, the accreditation of sufficient economic means to subsist in the country. At the same time, the children of native, naturalized or by option Argentines born abroad are recognized as permanent residents. The National Migration Department may proceed to the cancellation of the permanent residences granted in case it is proved that the foreigner resided outside Argentina for more than one year.

Finally, it is established that the National Migration Department will be the new agency in charge of granting Argentine citizenships. It will be required to have resided legally and continuously for two years in order to apply for Argentine citizenship. A new procedure to apply for Argentine citizenship is created for foreigners who prove before the National Migration Department that they have made a relevant investment in the country, regardless of the time of their residence in argentina.
