On July 7, 2025, executive orders No. 450/2025, 451/2025, and 452/2025 were published in the Official Gazette, through which the Executive Branch advanced with the reorganization of the regulatory framework for the electricity and gas sectors, pursuant to the powers granted by Law No. 27.742.
Executive order No. 450/2025 introduces amendments to Laws No. 15.336 and 24.065 to modernize the federal electricity regime. Key chances include promoting competition, increasing tariff transparency, encouraging private investment in an open and competitive market. It also strengthens the final users rights in the selection of electricity suppliers, restructures the Federal Electricity Council, and establishes new rules for power purchase agreements in the Wholesale Electricity Market.
Executive order No. 451/2025 approves the consolidated text of Law No. 24.076, which regulates the public services of natural gas transportation and distribution. This update aligns with the regulatory and institutional reforms introduced by Law No. 27.742 and is part of a broader effort to streamline and modernize the existing framework.
Executive order No. 452/2025 establishes the National Gas and Electricity Regulatory Authority, replacing ENARGAS and ENRE. The new entity will assume all regulatory and oversight responsibilities for both sectors, operating with administrative, functional, and budgetary autonomy. It will be governed by a five-member board appointed by the Executive Branch through a technical selection process.
These reforms aim to streamline the public sector’s regulatory structure, enhance oversight efficiency, and optimize the use of public resources, in line with the objectives set forth in Law No. 27.742.
