Argentine PTO becomes a body under the authority of the Secretariat of Industry and Commerce

By means of Executive Order 462/2025 (hereinafter, the “Order”), published in the Official Gazette on July 8, 2025, the National Executive Branch ordered the dissolution, transformation, and reorganization of various state agencies, with the aim of optimizing the use of public resources.

Among the measures adopted, the new regulation provides for the transformation of the National Institute of Industrial Property (hereinafter, the “INPI”), establishing that it will cease to operate as a decentralized agency and will become a decentralized body under the Secretariat of Industry and Commerce of the Ministry of Economy.

According to the provisions of the Articles 53 and 90 of the Order, the INPI will keep its role as the controlling authority of Trademarks and Designations Law No. 22,362, Patents and Utility Models Law No. 24,481, and Decree No. 6,673/63 on industrial models and designs. The regulation clarified that this transformation will not affect the continuity of the INPI’s essential functions, which will be ensured through the reorganization of its internal structure.

The Order also ordered the dissolution of other entities, such as the Regulatory Agency for the Hemp and Medicinal Cannabis Industry (ARICCAME), the National Institute of Family, Peasant and Indigenous Agriculture (INAFCI), the National Seed Institute (INASE), and the National Seed Commission, whose responsibilities will be absorbed by other Ministries and Secretariats.

Finally, it should be noted that, although the dissolution of the agencies takes immediate effect as of the publication of the Order in the Official Gazette, their functions will continue on a transitional basis until the institutional reassignment and implementation of new structures are completed.
