The Ministry of Economy redefines the advertising framework and sets guidelines for online gambling

November 3, 2025, Resolution No. 446/2025 of the Secretariat of Industry and Commerce (the “Secretariat”), under the Ministry of Economy (the “Resolution”), was published in the Official Gazette. The measure updates the regulatory framework governing the advertising of goods and services, with the aim of promoting clearer, more accessible, and reliable messages for consumers.

The Resolution provides that any advertisement constituting an offer must include a visible reference to a website or alternative communication channel detailing the terms of sale, duration of the offer, stock limitations, and information about the advertiser.

In the case of print and audiovisual media, the required statements must cover the full width of the advertisement and no less than five percent of its height, using highlighted typography that ensures readability. For radio advertisements, the information must be clear, audible, and free of background music.

Regarding advertisements that include financed prices, they must specify the number and amount of installments and the total effective annual financial cost, in accordance with the communication rules established by the Secretariat, to guarantee transparent information for consumers.

The Resolution also introduces new obligations for ticket resale websites, which must display on their main page, in a clearly visible manner, the statement “THIS IS A TICKET RESALE SITE,” in order to prevent confusion with official sales channels.

Lastly, specific conditions are established for the advertising of online gaming and betting in Annex I to the Resolution. All promotional materials must include the warning “COMPULSIVE GAMBLING IS HARMFUL TO YOUR HEALTH” and the legend “18+” . A reporting channel is enabled for users to report individuals or influencers who promote platforms that fail to comply with the established requirements.

Non-compliance with these provisions will be subject to penalties under Law No. 24.240 and the current fair trading regime.
