Through Resolution No. 536/2025 of the Ministry of Justice, published in the Official Gazette on August 18, 2025 (hereinafter, the “Resolution”), the Registry of Collective Management Organizations for Copyright and Related Rights was created. The registry will operate under the National Directorate of Copyright (“DNDA”) as an institutional tool designed to regulate procedures for the authorization, control, oversight, and transparency of civil organizations that collectively manage copyright and related rights.
Under this framework, any application for authorization to manage collective copyright and related rights must be submitted to the DNDA via the Online Procedures Platform (“TAD”). The Resolution also provides that organizations already recognized and authorized at the time the rule comes into effect will be automatically incorporated into the new registry, ensuring continuity of their operations and avoiding duplicate procedures.
Additionally, the Resolution grants the DNDA broad powers of oversight, inspection, and supervision over registered organizations, including the authority to request information, conduct audits, and issue complementary regulations necessary for the proper implementation of the system. Registered entities must also comply with periodic reporting obligations, such as submitting amendments to their bylaws, annual financial statements, and sworn declarations detailing collections, distributions, and agreements with foreign entities. Furthermore, the DNDA may issue additional technical and regulatory provisions required to implement the Resolution.
