New INASE regulation on the use of the term “Controlled Seed”

Through Resolution 306/2025, published in the Official Gazette on June 17, 2025, the National Seed Institute (“INASE”) approved a new regulation aimed at ensuring the quality and identity of controlled seeds, with special attention to those species for which such kind of seed is the only one authorized for commercialization.

Among the most relevant aspects, the regulation establishes the obligation to include the phrase “FISCALIZED SEED” on the IQR security label or official stamp on the package, in order to avoid confusion among buyers. It should be noted that this label is a sales authorization document issued by INASE, which certifies that the seed has been produced and conditioned in compliance with the control process of the agency, guaranteeing its genetic identity, purity, quality and health.

In this context, the resolution stipulates that the use of such term is reserved exclusively for INASE in connection with their placement on seed packages and labels. Any other use requires prior authorization from the agency.

The new regulation also establishes that the phrase “FISCALIZED SEED” must appear solely on the IQR security label or security stamp to comply with the requirements of the law, and not on other documents such as brochures, shipments, advertising or invoices, under penalty of non-compliance of incurring in the case of misleading advertising under Article 39 of Law 20.247 on Seeds and Phytogenetic Creations.

Finally, the Resolution grants a six-month grace period from its entry into force, during which no penalties will be applied in relation to packaging that do not comply with the new regulations.
