On September 15, 2020, the Ministry of Productive Development, by means of Resolution 488/2020, initiated a sunset review investigation due to the expiration of the legal term of the antidumping measures imposed by means of Resolution No. 946 dated September 17, 2015 of the former Ministry of Economy and Public Finances. Products subject to the aforementioned measures and the sunset review investigation for the trade operations to the Republic of Argentina (“Argentina”) are new rubber tires (pneumatic tires) of the type used in bicycles -which are classified under tariff code 4011.50.00 of the Mercosur’s Common Nomenclature- originating from the Kingdom of Thailand (“Thailand”), the Republic of Indonesia (“Indonesia”) and the People’s Republic of China (“China”).
The initiation of the sunset review investigation was requested by two local producers, Neubor S.A. and Imperial Cord S.A.
Pursuant to the Report on the Viability of the Review, the alleged dumping margins relating to the exports of the aforementioned products to Argentina were the following: (a) 43.73% with regard to exports from China; (b) 308.42% regarding exports from Thailand; and (c) 10.80% as regards exports from Indonesia. Moreover, the National Foreign Trade Commission preliminarily determined that sufficient evidence exists as to the recurrence of harm to the local industry, which thus merits the initiation of the procedure relating to the review of the antidumping measures currently in place.
Until the sunset review procedure concludes, the measures imposed through Resolution No. 946 issued in 2015 will remain in force with regard to exports of the abovementioned products to Argentina originating from Thailand, Indonesia or China.
Companies located in Thailand, Indonesia and China which export the abovementioned products to Argentina, as well as local companies importing them, can appear before the Ministry of Productive Development and request the questionnaires to participate in this investigation and be notified of the proceedings.
