By means of Law No. 32314, published in the Official Gazette on April 28, 2025, the Congress of Peru has amended the Cybercrime Law and the Criminal Code to define and increase penalties for criminal conduct committed through the use of artificial intelligence (AI) or similar technologies. This legislative reform sets a precedent in Latin America by formally recognizing the impact of AI on the commission of crimes.
Among the most significant changes, the law introduces aggravating factors for crimes committed using AI-based technologies, including deepfakes, in cases such as defamation, child pornography, fraud, and copyright infringement (specifically regarding the reproduction, dissemination, distribution, and circulation of a work).
The reform also increases the penalties established under Law No. 30096 on Cybercrime when such offenses are committed using AI.
Additionally, it introduces new criminal offenses related to the circumvention of technological protection measures for intellectual works, including the manufacture, commercialization, or provision of services intended to bypass such mechanisms.
Finally, the law establishes a 60-day deadline for the Executive Branch to issue complementary regulatory provisions to implement the new legislation.
