The Secretariat of Public Innovation declared the opening of the Consultation procedure on General Guidelines of the Draft General Regulations for Satellite Management and Services

On August 13, Resolution No. 57/2020 (hereinafter, the “Resolution”) was published in the Official Gazette of the Argentine Republic, declaring the opening of the Consultation Document procedure provided for in article 44 and following of Annex I “General Regulations for Public Hearings and Consultation Documents for Communications”, approved by Resolution No. 57/1996 of the former Secretariat of Communications, of the Consultation Document on “General Guidelines of the Draft General Regulations for Satellite Management and Services”.

The Consultation Document is included in Annex I of the Resolution. It establishes the need to evaluate the updating of current satellite regulations.

  • Purpose of the proposal

The benefits of an updated Regulation will focus on streamlining and making procedures more transparent, as well as integrating new technologies to contribute to their efficiency and optimization.

The purpose is to receive contributions and recommendations on the update of Part I of the General Regulations on Satellite Management and Services, whose consolidated text was duly approved by Resolution No. 3609/1999 of the former Secretariat of Communications, referring to the “Provision of satellite facilities by geostationary satellites in the Fixed and Broadcasting Satellite service”, as well as Part II of the General Regulations on Satellite Management and Services, duly approved by Resolution No. 2325/1997 of the former Secretariat of Communications, referring to the “Provision of Global Satellite Communications Services through Non-Geostationary Orbit Satellite Constellations”. They are part of the Resolution as Annex I (Resolution 3609/99) and Annex II (Resolution 2325/97)[1].

There is particular interest in obtaining comments and opinions regarding the following points:

  1. Priority of Use in accordance with Article 35 of Law 27.078;
  2. Completion of the authorization procedure based on reciprocity agreements and any alternative procedure for the future;
  3. Suggested procedure for the authorization of future non-geostationary constellations – Possible update of Part II of the Regulations;
  4. All other considerations on aspects that should be considered in the aforementioned Regulation.
  • Procedure

Opinions and proposals must be submitted on the Remote Procedures Platform (TAD), in accordance with the provisions of Decree No. 1063/2016 and complementary regulations, or in writing, in paper format at the Entries, Exits and Archives Desk of the Secretariat of Public Innovation, located at Av. Presidente Roque Sáenz Peña 511, 1st floor, in the Autonomous City of Buenos Aires, or in some of the Delegations of the National Communications Entity (ENACOM) in the interior of the country, within thirty (30) business days from August 13, 2020.

Interested parties must complete the following information:

  1. Name and Surname/Company Name;
  2. DNI/CUIT/CUIL;
  3. Profession/Activity;
  4. Email;
  5. Phone;
  6. City;
  7. Province.

Comments may also be submitted through the website www.argentina.gob.ar/jefatura/innovacion-publica/ssetic, which will have a special section for this purpose. Comments submitted under this modality will be considered informal, in accordance with the provisions of Article 17 of Annex V of Decree 1172/2003 on Access to Public Information.
