Public Health Emergency COVID-19. Resolution No. 304/2020 issued by ENACOM regarding postal services

On March 26, 2020, Resolution No. 304/2020 of ENACOM was published in the Official Gazette of the Argentine Republic.

Resolution No. 304/2020, hereinafter referred to as “the Resolution,” establishes that during the validity of the “Preventive and Mandatory Social Isolation” ordered by the Emergency Decree No. 297/2020, postal services for control letters with signature on the sheet, control letters with return receipt, express letters, letters with acknowledgment, confront letters, packages, parcels, credit cards, door-to-door services, telegrams, and official letters (“carta documento”) may be considered delivered without the recipient’s handwritten signature or that of a person at the destination address.

Below we detail the requirements that postal service providers must comply with in each case.

CONTROL LETTERS WITH SIGNATURE ON THE SHEET, CONTROL LETTERS WITH RETURN RECEIPT, EXPRESS LETTERS, LETTERS WITH ACKNOWLEDGMENT

The distributor or mail carrier must record the full name of the recipient on the sheet or on a mobile electronic device.

CONFRONT LETTERS, PACKAGES, PARCELS, CREDIT CARDS, DOOR-TO-DOOR SERVICES

Before duly recording the recipient’s data, the distributor or mail carrier must verify the recipient’s identity by having them show an identity document at a reasonable distance. The recipient must be the addressee or a person over 18 years of age present at the address.

OFFICIAL LETTERS (“CARTA DOCUMENTO”) AND TELEGRAMS

In addition to the identity verification requirements and full recording of data on a physical sheet or mobile electronic device mentioned above, additional information must be included, such as a description and/or image of the delivery location, special delivery code, and/or other methods that allow the correct identification of the recipient.

Finally, the Resolution establishes that in properties subject to horizontal property regime (buildings and/or gated communities), delivery may be made to the building manager and/or responsible personnel present at the access point.
