The Brazilian National Congress passed bill of law 2628/2022, which establishes a regulatory framework for the protection of children and adolescents in digital environments. The initiative applies to all digital products and services accessible to minors in Brazil, regardless of their origin.
The law introduces new obligations for providers of digital products and services, including the implementation of age verification mechanisms and parental controls. It also prohibits profiling minors for advertising purposes and bans the offering of “loot boxes” in video games, as this practice is deemed comparable to gambling.
In addition, the law provides for the creation of an independent authority to monitor compliance and enforce sanctions, which may range from warnings to fines of up to 10% of the group’s revenue in Brazil, with a maximum of BRL 50 million per violation, as well as suspension or prohibition of activities.
The bill of law has been submitted to the Executive Branch for presidential sanction.
