On August 30, 2023, the Public Information Access Agency published Resolution No. 161/2023, whereby it enacted the Transparency and Personal Data Protection for the Use of Artificial Intelligence Program (the “Program”).
The purpose of the Program is to strengthen the State’s abilities in the utilization and development of Artificial Intelligence in both private and public sectors, pursuant to the Recommendations on the matter issued by the Organization for Economic Co-operation and Development (OECD), the United Nations Educational, Scientific and Cultural Organization (UNESCO) and the Public Innovation Secretariat under the executive branch of government.
The dispositions set forth in the Program include:
- Identification of key government and nongovernment actors involved on the subject;
- Monitoring of regional and global advances in the regulation of Artificial Intelligence technological developments;
- Preparation of periodic reports and statistics;
- Institutionalization of a Multidisciplinary Advisory Council with experts in the field, for consensus-building on sectoral policies.
- Preparation of collaborative strategies between competent state agencies on regulations to prevent the violation of rights and other negative impacts of Artificial Intelligence;
- Publication of transparency and personal data protection guidelines for the use of Artificial Intelligence;
- Training courses and technical assistance on transparency and personal data protection for the use of Artificial Intelligence;
- Awareness, media, and information literacy campaigns; and
- Documentation of the Automated Decision Making (ADM) systems and publication of transparency criteria on the National Transparency Website.
