Argentina Initiates Sunset Review of antidumping duties on imports of pumps for cooling liquid or water for spark ignition or compression engines from China

On September 17, 2020, the Ministry of Productive Development, by means of Resolution No. 490/2020, initiated a sunset review investigation due to the expiration of the legal term of the antidumping measures imposed by means of Resolution No. 1,011 dated September 25, 2015 of the former Ministry of Economy and Public Finances. Products subject to the aforementioned measures and to the sunset review investigation for the trade operations to the Republic of Argentina (“Argentina”) are pumps for cooling liquid or water for spark ignition or compression engines, with a capacity ranging from two cubic meters per hour (2 m3/hour) to eighteen cubic meters per hour (18 m3/hour), destined to the non-original replacement market, weighing between zero point five kilograms (0.5 kg) and eighteen kilograms (18 kg) per unit, and for engines of cars, trucks, vans, utility vehicles, agricultural equipment, tractors, boats, generators, mobile power plants and other fixed spark or compression ignition engines, except engines for railway and aerial uses and pumps of the following brands: Kia, Mitsubishi, Caterpillar, Yue Jin, Chrysler, Cummins, Deutz, and Suzuki -which are classified under tariff code 8413.30.90 of Mercosur’s Common Nomenclature- originating from the People’s Republic of China (“China”).

The initiation of the sunset review investigation was requested by a local producer, VMG S.A.

Pursuant to the Report on the Viability of the Review Procedure, no dumping margin relating to the exports of the aforementioned products to Argentina has been determined. Nevertheless, the alleged recurrent dumping margin calculated in connection with exports of the abovementioned products from China to Uruguay was estimated at 44%. Moreover, the National Foreign Trade Commission preliminarily determined that sufficient evidence exists as to the recurrence of harm to the local industry, which thus merits the initiation of the procedure relating to the review of the antidumping measures currently in place.

Until the sunset review procedure concludes, the measures imposed through Resolution No. 1,011 issued in 2015 will remain in force with regard to exports of the abovementioned products to Argentina originating from China.

Companies located in China which export the abovementioned products to Argentina, as well as local companies importing them, can appear before the Ministry of Productive Development and request the questionnaires to participate in this investigation and be notified of the proceedings.
