On September 11, 2023, the Ministry of Economy of Argentina, by means of Resolution No. 1328/2023, initiated a sunset review of the antidumping duties imposed on exports of glass wool bonded with thermosetting phenolic resins, with or without coating, from Mexico, which is classified under tariff code 7019.39.00 of the Mercosur’s Common Nomenclature.
The initiation of the sunset review was requested by local producer Saint Gobain Argentina S.A.
The alleged dumping margin for the purposes of the initiation of the investigation was estimated at 161.76% for operations originating in Mexico, which was calculated based on the exports from Mexico to Chile, since there were no exports of the product under review from Mexico to Argentina during the past year. Moreover, the National Foreign Trade Commission preliminarily determined that sufficient evidence exists as to the recurrence of injury to the local industry, which provides reasonable grounds for the initiation of the sunset review.
During the sunset review, the antidumping duties imposed by the former Ministry of Production by means of Resolution No. 5 dated September 12, 2018, will not remain in force. Therefore, as from September 13, 2023, exports of the products from Mexico to Argentina are not subject anymore to an antidumping duty.
Companies located in Mexico which export the abovementioned products to Argentina, as well as local companies importing them into Argentina, can appear before the Ministry of Economy, request the questionnaires to participate in this investigation and be notified of the proceedings.
