Proposal to modify the amount of the administrative penalties of the Argentine Personal Data Protection Law

Section 77 of the Bill for the General Budget of the National Administration establishes an amendment to Section 31 of Law No. 25326, which regulates administrative penalties in the scope of personal data protection in Argentina.

The amendment provides that fines will be established on the basis of a mobile unit, the value of which is determined at TEN THOUSAND ARGENTINE PESOS (ARS 10,000). In addition, the reform proposes the annual update of fines, which will range from a minimum of FIVE (5) mobile units to a maximum of ONE MILLION (1,000,000) mobile units, providing for penalties proportional to the seriousness of the infringements. The purpose of the reform is to adapt the penalties to inflation and to guarantee their enforcement.
