The Agency for Access to Public Information (“AAIP”) regulated on the interpretation of “genetic data” in the application of Argentine Personal Data Protection Act 25.326 (“PDPA”)

The AAIP has included “genetic data” in the definition of sensitive personal data.

In this regard, the AAIP defined genetic data as “data relating to the inherited or acquired genetic characteristics of a human person that provide information about his or her physiology or health”. Consequently, it is necessary to implement higher levels of security, confidentiality, restrictions on access, use and circulation in the processing of genetic data.
