New Scenario for the Transmission and Distribution of Electricity and Gas in Argentina

On December 18, 2023 Decree No. 55/2023 was published in the Official Gazette by means of which the Executive Power declared the state of emergency of the Argentine National Energy Sector until December 31, 2024, with respect to certain segments which include power generation, transportation and distribution subject to federal jurisdiction segments, and natural gas transportation and distribution segments.

Likewise, the Secretary of Energy was instructed to prepare and implement a plan for the above mentioned segments, providing mechanisms to fix competitive prices, maintain levels of income in real terms, and cover investment needs, for purposes of guaranteeing the continuous provision of the power and natural gas transportation and distribution public services, according to technical and economic conditions adequate for suppliers and users.

Furthermore, the Executive Power declared the commencement of a tariff review for suppliers of power transportation and distribution subject to federal jurisdiction public services, as well as for suppliers of transportation and distribution of natural gas public services, providing that the resulting new tariffs must become effective no later than December 31, 2024.

Finally, the Executive Power declared the intervention of the Argentine power authority (“ENRE”) and the Argentine gas authority (“ENARGAS”) as from January 1, 2024, and until the members of the board of such regulators are appointed by the incoming Secretary of Energy.
